Terms governing access to and use of the ElioHealth pilot service

These Terms of Service ("Terms") govern your access to and use of the ElioHealth website, application, dashboards, wearable integrations, and related services (together, the "Service"). ElioHealth is operated for a private Community Church wellness pilot by the ElioHealth pilot administrator ("ElioHealth", "we", "us", or "our").

The full legal identity of the pilot administrator is provided directly to invited participants during onboarding, consent, or upon request. Technical development, hosting, maintenance, and support may be provided by contracted service providers acting under instructions from the pilot administrator.

By using ElioHealth or participating in the pilot, you agree to these Terms. If you do not agree, do not use the Service.

1. Nature of the Service

ElioHealth is a privacy-first wellness platform designed to support wearable integrations over time. In the current pilot phase, the Service uses Oura as the first supported integration and may expand to additional compatible data sources in future phases, subject to technical, legal, and partner approval.

ElioHealth is a limited, invite-only proof-of-concept service intended to support wellness tracking, self-observation, and optional advisor guidance for a closed participant group within a Community Church setting. Participation is voluntary and self-enrolled.

2. No Medical Care

ElioHealth provides wellness-oriented information and optional advisor guidance only.

ElioHealth is not:

  • a doctor or healthcare provider;
  • a medical device;
  • a diagnostic system;
  • a treatment provider;
  • an emergency service; or
  • a substitute for professional medical advice, diagnosis, or treatment.

Any wellness comments, alerts, dashboard views, or advisor communications are for general wellness support and self-observation. If a licensed healthcare professional participates in the pilot as an advisor, that professional remains responsible for their own professional obligations. ElioHealth itself does not create a doctor-patient relationship.

You should seek qualified medical advice for any medical concern and contact emergency services in an emergency.

3. Eligibility

To use ElioHealth, you must:

  • be at least 18 years old;
  • be invited or otherwise authorized to participate in the pilot;
  • voluntarily self-enroll in the pilot;
  • have authority to connect any wearable account you choose to authorize;
  • provide any required consent for wellness-data processing and advisor access; and
  • comply with these Terms.

4. Account Structure and Identity Model

ElioHealth is designed to minimize direct identifiers and to present participant data to authorized advisors using platform-generated aliases wherever reasonably possible.

You understand and agree that:

  • the Service may assign you a random internal participant identifier and platform alias;
  • the Service uses an offline-issued participant code during onboarding and account linking so the online analytics environment does not routinely require your real name, email address, or phone number;
  • advisors and authorized staff may interact with your data through that alias rather than your real name where practical;
  • a small authorized administration function may separately hold the minimum identity, contact, and consent information needed for onboarding, support, withdrawal, and participant-requested follow-up;
  • technical credentials or provider account references needed to operate the connection may be stored separately from the analytics environment; and
  • the Service remains subject to applicable data protection law even where it operates pseudonymously and is not described as anonymous for legal purposes.

5. Current Wearable Integration

In the current pilot phase, ElioHealth uses Oura as the first supported wearable integration.

If you choose to connect Oura:

  • you authorize ElioHealth to access the Oura data categories you expressly permit through the authorization flow;
  • you understand that Oura may require an active Oura membership or account conditions for certain features or API access;
  • you may revoke the connection at any time through the applicable authorization settings, where available, or by contacting us;
  • you may request access to Oura-sourced data collected through the Service;
  • your use of Oura remains subject to Oura's own terms, privacy policy, account settings, and developer platform rules; and
  • we must handle Oura-sourced data in accordance with applicable Oura developer terms, including any restrictions on retention, storage, deletion, and third-party access.

ElioHealth is an independent service and is not affiliated with, endorsed by, sponsored by, or operated by Oura unless expressly stated otherwise.

6. Participant Responsibilities

You agree to:

  • provide truthful information where the Service requests it;
  • maintain the confidentiality of any credentials under your control;
  • use the Service only for lawful purposes;
  • refrain from attempting to interfere with, probe, reverse engineer, scrape, or disrupt the Service;
  • respect the privacy and confidentiality of other participants, advisors, and staff;
  • avoid sharing another participant's information without permission;
  • notify us if you wish to withdraw from the pilot; and
  • notify us if you believe your account, wearable connection, or any related communication channel has been compromised.

7. Advisor and Staff Access

Where you have provided explicit consent, authorized advisors, wellness staff, or a Community Church-appointed doctor may view your wearable-derived data through role-restricted dashboard views.

Advisor access is limited to the minimum scope reasonably necessary for the pilot purpose, is subject to internal controls, and is logged where technically supported. Advisor access does not convert ElioHealth into a medical device, medical provider, diagnostic system, or emergency monitoring service.

You may withdraw advisor-access consent or withdraw from the pilot as described in the Privacy Policy.

8. Communications

ElioHealth may provide in-product communications and, where offered and enabled by you, optional external communications channels for onboarding, support, pilot updates, withdrawal requests, or participant-requested follow-up.

You agree not to use any communication feature to transmit unlawful, abusive, infringing, confidential third-party, or harmful content.

9. Privacy

Your personal data is handled in accordance with the ElioHealth Privacy Policy, which forms part of these Terms by reference.

In summary:

  • ElioHealth is designed to minimize direct identifiers;
  • the analytics environment does not routinely retain direct personal identifiers;
  • wearable data is treated as protected personal data;
  • advisor visibility requires explicit participant consent;
  • Oura-sourced data is handled under applicable Oura developer terms;
  • Oura may collect usage data relating to use of its API or platform as described in Oura's own terms and privacy policy; and
  • you may request access, deletion, or withdrawal of consent as described in the Privacy Policy.

10. Pilot Status and Availability

You acknowledge that ElioHealth is a proof-of-concept pilot and that:

  • features may change, be limited, or be withdrawn;
  • integrations may be added, changed, suspended, or removed;
  • wearable-provider availability, data completeness, and API access are outside our control;
  • uptime and continuity are not guaranteed;
  • the Service may be modified or discontinued at any time, with reasonable notice where practicable; and
  • access may be limited to a small number of participants during testing.

11. Intellectual Property

Except for your own personal data and any rights granted by law, ElioHealth and its licensors retain all right, title, and interest in the Service, software, content, branding, documentation, dashboard design, and related materials.

You may not copy, reproduce, distribute, modify, scrape, benchmark, or reverse engineer any part of the Service except as permitted by law or with our prior written consent.

12. Third-Party Services

The Service may depend on third-party providers, including Oura in the current pilot phase. We are not responsible for the availability, accuracy, completeness, acts, omissions, account decisions, pricing, membership requirements, or independent policies of third-party services.

Your use of any third-party service remains governed by that third party's own terms and policies.

To the maximum extent permitted by law, third-party service providers involved in or connected to the Service disclaim all implied warranties, including implied warranties of merchantability, fitness for a particular purpose, and non-infringement, and are not liable for consequential, special, punitive, indirect, or incidental damages arising from your use of the Service.

13. Suspension and Termination

We may suspend or terminate access to the Service if:

  • you materially breach these Terms;
  • you withdraw from the pilot or revoke required consent;
  • we are required to do so by law;
  • a third-party integration becomes unavailable, restricted, or legally limited;
  • applicable Oura developer terms require suspension, deletion, or access restriction; or
  • continued operation would create security, legal, privacy, or operational risk.

You may stop using the Service and withdraw from the pilot at any time.

Where the Service ends or your participation is terminated, personal data will be handled in accordance with the Privacy Policy.

14. Deletion, Revocation, and Withdrawal

You may disconnect your wearable integration, withdraw advisor-access consent, or withdraw from the pilot.

After revocation or withdrawal, ElioHealth will stop collecting new wearable data from the relevant integration and will delete or de-identify retained personal data according to the Privacy Policy, unless retention is required by law, needed for security or legal claims, or otherwise permitted under applicable integration terms and participant consent.

15. Disclaimers

To the maximum extent permitted by law, the Service is provided "as is" and "as available."

We do not warrant that:

  • the Service will be uninterrupted, secure, or error-free at all times;
  • any wearable integration will remain available;
  • any wearable-provider membership, device, account, or API feature will remain unchanged;
  • any data from a wearable provider will be complete, accurate, timely, or clinically meaningful;
  • any dashboard trend, alert, or wellness insight will be suitable for a particular purpose; or
  • advisor review will detect, prevent, or respond to any medical issue.

16. Limitation of Liability

To the fullest extent permitted by applicable law, ElioHealth, the pilot administrator, the participating community organization, and their officers, employees, contractors, advisors, volunteers, and service providers will not be liable for any indirect, incidental, special, consequential, exemplary, or punitive damages arising out of or related to your use of the Service.

Nothing in these Terms excludes or limits liability that cannot lawfully be excluded or limited under applicable law, including liability arising from fraud, willful misconduct, or death or personal injury caused by negligence where such limitation is prohibited.

If liability is not otherwise excluded, our aggregate liability for claims arising out of or related to the Service will be limited to the greater of:

  • the amount you paid us for the Service in the 12 months before the event giving rise to the claim; or
  • USD 100.

17. Indemnity

You agree to indemnify and hold harmless ElioHealth, the pilot administrator, the participating community organization, and their officers, employees, contractors, advisors, volunteers, and service providers against claims, losses, liabilities, damages, and reasonable costs arising out of your unlawful use of the Service, your misuse of another person's data, or your breach of these Terms, except to the extent caused by our own breach of law or these Terms.

18. Governing Law and Jurisdiction

These Terms are governed by the laws of the Hong Kong Special Administrative Region, without regard to conflict-of-law principles.

The courts of the Hong Kong Special Administrative Region shall have exclusive jurisdiction over disputes arising out of or in connection with these Terms, unless mandatory consumer or data protection law requires otherwise.

19. Changes to these Terms

We may revise these Terms from time to time. If we make material changes, we will provide notice appropriate to the nature of the change and update this page accordingly.
